Promotional Period	Start Date: 11.59pm (Melbourne time) on 28 September 2018
End Date: 11.59pm (Melbourne time) on 7 October 2018
Eligible Participants	Entry is open to Australian (excl. SA) residents aged 18+ who hold an account with one of the Promoter's licensed subsidiaries: TAB Limited, Tabcorp Wagering Manager (Vic) Pty Ltd or Tabcorp ACT Pty Ltd. The directors, officers and employees of the Promoter and its related bodies corporate and their immediate families and any of the Promoter's contractors associated with this Promotion and their immediate families are not eligible to participate in this Promotion. Excluded Persons are not eligible to participate in this Promotion. "Excluded Persons" means any person identified as: a minor; self-excluded patron or involuntarily excluded patron; a customer who has been previously excluded from promotions (including Promo Offers) conducted by the Promoter and whom the Promoter has notified about their ineligibility for this Promotion; a resident of the state of South Australia; and directors or management of a corporate bookmaker. If a person is identified as an Excluded Person, the Promoter reserves the right to refuse to allow the person to take part in the Promotion, or receive, any or all aspects of the Prize, and the Promoter will notify any relevant regulator accordingly where required by law to do so. To qualify as the Winner, Eligible Participants must be available and willing to travel to Sydney from 12 October 2018 to 14 October 2018, if requested by the Promoter.
How to enter	During the Promotional Period, Eligible Participants who: Accept the T&Cs for "The Everest Climber"; Play "The Everest Climber" on the TAB App; and Successfully reach the summit and submit their entry, in accordance with all instructions and FAQs provided on the TAB App, will be deemed to be "*Eligible Entrants*."
Number of entries permitted	Eligible Participants may only enter the Promotion once per customer.
Conduct of Prize Draw	Entries from Eligible Entrants will be placed into a draw, to be conducted at 11.00am (Melbourne time) on 8 October 2018 at the Promoter's address, by way of an Excel random number generator in the presence of an Independent Scrutineer. The first 5 entries from Eligible Entrants drawn will be the winners ("Winners"). When conducting the prize draw, the Promoter may also draw reserve winner/s ("*Reserve Winner/s*").
Prize	Each Winner will win the Prizes set out below on the conditions below. The total potential value of the prize pool is around $525,000. The total prize pool will only reach this amount if the horse nominated by TAB to run in The Everest ("*TAB Nominated Horse") wins The Everest thoroughbred race at Royal Randwick Racecourse (official results only, protests, scratchings apply (as defined in the NSW Totalizator Betting Rules). The Promoter reserves the right to select the TAB Nominated Horse at their sole discretion that will qualify the Winners for the Major Prize. The TAB Nominated Horse will run in the 2018 The Everest. If the TAB Nominated Horse is scratched for any reason prior to The Everest, the Winners will be allocated the Promoter's emergency runner, as deemed by Racing NSW stewards ("Secondary Horse"*). In the event that there is no emergency runner allocated (late scratching), the Winners will not be allocated a secondary horse and no one is eligible for the Major Prize. As at the date of printing, the TAB Nominated Horse is In Her Time, trained by Ben Smith. Should the TAB Nominated Horse change, for whatever reason, the Promoter will publish this fact on its website at www.tab.com.au.

ID Verification: The Winner must re-verify their full legal name, date of birth and current residential address by providing the Promoter with original, certified copies of their identification documents in accordance with the TAB Account Verification Requirements as set out at tab.com.au. The Winner will not be awarded the Prize until their identity has been successfully re-verified by the Promoter. Prize values are GST inclusive, are in Australian dollars and are the recommended retail values as provided by the supplier (or an appropriate estimate of such value) and are correct at time of printing. Should a Winner ordinarily reside in Sydney, no flights will be included in the Minor Prize for that Winner (or their guest, regardless of where their guest ordinarily resides).
Major Prize In the event that the TAB Nominated Horse wins The Everest, each Winner will receive $100,000. (Total Major Prize Pool is $500,000)	$100,000	If the TAB Nominated Horse (or in the case of an early scratching of the TAB Nominated Horse, the Secondary Horse) does not win The Everest, no Major Prize will be awarded under this Promotion. If the number of Winners is less than 5, the value of the Major Prize awarded to the Winners will not change; that is, the Winners will only receive $100,000. Dead Heat: In the event that the TAB Nominated Horse wins The Everest Race in a dead heat with another horse, each Winner will receive $50,000. In the event that the TAB Nominated Horse wins The Everest Race in a dead heat with three other horses, each Winner will receive $25,000. Abandoned Promotional Race: if the Promotional Race is: abandoned in its entirety and not postponed: the Winners will receive the Minor Prize but all Winners will forfeit any entitlement to the Major Prize; or run and abandoned by the Racing NSW Stewards before the runners finish and the Promotional Race will not be postponed: the Winners will only receive the Minor Prize but all Winners will forfeit any entitlement to the Major Prize. Postponed Promotional Race: if the Promotional Race is postponed or scheduled for a different date, the Winners will receive the Minor Prize (on the original dates set out) and all Winners will still be entitled to win the Major Prize when the Promotional Race is run. The Winner(s) must provide the Promoter with the details of their nominated Australian bank account that is held in the Winner's name within five (5) business days of being notified that they have won the Prize by sending the Promoter a copy of a bank statement showing the Winner's nominated bank account details, name and current residential address. The Promoter will complete their payment of any Major Prize by 12 November 2018.
Notification of prize winners	The Winners will be notified in writing by 12:00pm (Melbourne time) on 9 October 2018 via the email address and/or telephone number provided by the Winner on entering the Promotion. The Winners will be notified publicly by publishing their details on tab.com.au.
Unclaimed prizes or ineligible Winners	In the event that for any reason whatsoever a Winner does not accept a Prize (including if the Promoter is not able to successfully get in contact with the Winner) by 12:00pm (Melbourne time) on 10 October 2018, or if the Winner is determined to not be an Eligible Participant or to not be entitled to the Prizes pursuant to these Conditions of Entry, then the Prizes will be forfeited by the Winner and the first selected Reserve Winner will be deemed to be the winner of the Prizes ("Unclaimed Prize Winner"). Where there are multiple Winners that forfeit the Prizes, the Prizes will be allocated to Reserve Winners from highest value to lowest value in the order that the Reserve Winners were drawn. The Unclaimed Prize Winner will be notified in writing by 2.00pm (Melbourne time) on 10 October 2018 via the email address and telephone number provided by the Unclaimed Prize Winner on entering the Promotion. In the event that for any reason whatsoever the Unclaimed Prize Winner does not accept the Prize (including if the Promoter is not able to successfully get in contact with them) by 2.00pm (Melbourne time) on 12 October 2017, or if the Unclaimed Prize Winner is determined to not be an Eligible Participant or to not be entitled to the Prizes pursuant to these Conditions of Entry, then the Prizes will be forfeited by the Unclaimed Prize Winner and no replacement Prizes will be awarded.

Play "The Everest Climber" on the TAB App; and

Number of entries permitted

Eligible Participants may only enter the Promotion once per customer.

Conduct of Prize Draw

Entries from Eligible Entrants will be placed into a draw, to be conducted at 11.00am (Melbourne time) on 8 October 2018 at the Promoter's address, by way of an Excel random number generator in the presence of an Independent Scrutineer.

Prize

Each Winner will win the Prizes set out below on the conditions below.

The Promoter reserves the right to select the TAB Nominated Horse at their sole discretion that will qualify the Winners for the Major Prize. The TAB Nominated Horse will run in the 2018 The Everest.

Abandoned Promotional Race: if the Promotional Race is:

abandoned in its entirety and not postponed: the Winners will receive the Minor Prize but all Winners will forfeit any entitlement to the Major Prize; or

General Terms and Conditions

Any person entering this promotion ("you") acknowledges and agrees that you have read these Conditions of Entry and that by entering the Promotion you are deemed to have accepted these Conditions of Entry.

Taxes

Any taxes which may be payable as a consequence of the Winner or Unclaimed Prize Winner receiving the Prize are the sole responsibility of the Winner/Unclaimed Prize Winner. The Promoter encourages the Winner to seek independent financial and tax advice.

Exclusion of Liability

Whilst the Promoter will use all reasonable endeavours to arrange the delivery of the Prize, by entering this Promotion, a Winner/Unclaimed Prize Winner acknowledges that circumstances beyond the control of the Promoter may prevent the delivery of the Prize (including the failure by the Winner/Unclaimed Prize Winner to notify the Promoter of any change to their delivery details). In such circumstances where the Promoter forms a reasonable belief that any delay or loss of the Prize has not been caused or contributed by the Winner's negligence, fraud or misconduct, the Promoter may (if circumstances permit) re-deliver the Prize to the Winner.
To the extent permitted by law, the Promoter is not liable for any loss, including, but not limited to, direct, consequential (including economic) or indirect loss or any loss of profits, by reason of any act or omission, deliberate or negligent, by the Promoter or their servants or agents, in connection with this Promotion or the arrangement for supply, or the supply or failure to supply, of any goods or services by any person to a Winner or Unclaimed Prize Winner.
Nothing in these Terms and Conditions affect, nor is intended to affect, any rights that you might have that are not able to be excluded under applicable Australian consumer protection laws.

Use of Personal Information / Marketing

The Promoter complies with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth).
Any entries become the property of the Promoter. Any information provided will be used by the Promoter for the purpose of conducting this Promotion.
The Promoter may disclose your personal information to its contractors and agents to assist in conducting this Promotion or communicating with you.
By entering the Promotion, you consent to your personal information being collected, used and disclosed by the Promoter, its agents, affiliates, related business companies, other companies associated with this Promotion, and business partners for any promotional activities, including your personal participation in reasonable promotional activities as requested by the Promoter, and any marketing and publicity purposes without any further reference, payment or other compensation to you.
Your consent includes authorising the Promoter, its agents, affiliates, related business companies, other companies associated with this Promotion and business partners to send you future direct mail and/or electronic messages including but not limited to, SMS, MMS, and email regarding any promotional, marketing and publicity activities.
You consent to the notification of your personal information to any relevant regulator or state or territory department where required by law to do so. Your personal information may be disclosed to State and Territory lottery departments and Winner's names published as required under the relevant lottery legislation. The Promoter will use reasonable endeavours to provide you reasonable prior notice where their personal information is going to be disclosed to State and Territory lottery departments or published under lottery legislation. A request to access, update or correct any personal information should be directed to the Promoter.
You consent to the publication of their name and suburb of residence (however their full address will not be published) and agree to participate in reasonable Promotion activities as requested by the Promoter without any further payment or compensation.
You understand and accept the Promoter's Privacy Policy located on the Promoter's website, www.tab.com.au.

General

The Promoter, its employees, officers, agents and its parent companies and subsidiaries are not responsible for and shall not be liable for:
1. any condition caused by events beyond the control of the Promoter that may cause the Promotion to be disrupted or corrupted;
2. any injuries, losses (including, without limitation, loss of profits), or damages of any kind caused by the Prize or resulting from acceptance, possession, use, or misuse of the Prize, or from participation in the Promotion or downloading material from tabrewards.com.au or tab.com.au; or
3. any printing or typographical errors in any materials associated with the Promotion.
The Promoter reserves the right to:
1. conduct a review of publicly available information and other information available to the Promoter in relation to the Winner, Unclaimed Prize Winner and, if applicable, their guest/s (which may include politically-exposed person, public record, social media, adverse media and other background checks) for the purpose of assessing the honesty and integrity of the relevant Winner, Unclaimed Prize Winner and, if applicable, their guest/s;
2. in its sole and unfettered discretion, disqualify a Winner and/or Unclaimed Prize Winner or, if applicable, require a Winner and/or Unclaimed Prize Winner to select an alternative guest, where any check referred to in paragraph 4(b)(i) returns an adverse outcome;
3. cancel or suspend the Promotion, should the security, fairness, integrity, or proper operation of the Promotion be compromised in any way by way of any virus or bugs in the IT system used for this Promotion, unauthorised human intervention, or other causes beyond the reasonable control of the Promoter;
4. disqualify any Eligible Participant who engages in offensive, illegal or objectionable conduct in respect of this Promotion;
5. disqualify any Eligible Participant who tampers with the entry process, or who submits an entry that is not in accordance with these Terms and Conditions;
6. cancel, terminate, modify or suspend the Promotion in accordance with any written directions given by any relevant government or regulatory authority to do so;
7. request a Winner or Unclaimed Prize Winner provide proof of age, identity or proof of residency at the nominated Prize delivery address.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, systems failures, tempests, natural disasters, acts of God, civil unrest or strikes, the Promoter may in its absolute discretion cancel the Promotion or part of the Promotion and recommence it from the start on the same conditions subject to Australian law.
By entering this Promotion, you acknowledge that it is a condition of accepting the Prize that you may be required to sign a legal release in a form reasonably determined by the Promoter.
To the extent that a situation or issue arises for which these Terms and Conditions make no provision or in relation to which the relevant Terms and Conditions are unclear, the Promoter will make a decision regarding such situation. You will have the right to request an internal review of the Promoter's decision. Subject to any regulator direction to the contrary, the decision of the internal review will be final and binding.
In the event that a Winner or Unclaimed Prize Winner is identified as being in breach of these Terms and Conditions (the "Refused Winner"), the Promoter reserves the right to refuse to allow the Winner to take part in, or receive, any or all aspects of the Prize, and the Promoter will notify any relevant regulator accordingly where required by law to do so.
